TERMS OF SERVICE

By ordering from me you are automatically agreeing to the following terms of service.

DEFINITIONS

  1. Artist – Hauntwired (@hauntwired )

  2. Client – The person or persons the Artist is hired by to work on a Project.

  3. Third Party – Any person or persons NOT subject to this Terms of Service Agreement.

  4. Artwork – The final, finished, and completed work of art made for hire by Artist for Client subject to this Terms of Service Agreement.

  5. Project – Any collection or group of Artwork, to include any and all Sketches, WIPs, ALTS, and IP generated as a part of the production of Artwork.

  6. Sketch – Any rough drawing or in-progress work created in the process of the commission process subject to this Terms of Service Agreement.

  7. Private Commission – Any Project that will not be shared by Artist on their official artwork profile(s) [§2.6] as per an agreement with Client.

  8. Major Edit – Any edit to Artwork requiring 15% or more of total effort/time to incorporate into the Artwork. Examples include, but are not limited to:
    a. Repositioning of a character’s body or limbs requiring redrawing.
    b. Addition of large character features (antlers, wings, permanent accessories, etc.) which are not listed on any reference or description provided to Artist by Client at hire.

  9. Minor Edit – Any edit to Artwork requiring less than 15% total effort/time to incorporate into the Artwork.

  10. Transfer – The resale, gifting, or trade of Artwork to any Third Party.

  11. ALT – Additional or “alternate” versions of Artwork. Examples of ALTs include, but are not limited to:
    a. SFW variations
    b. different expressions
    c. multiple/alternate outfits
    d. addition of or removal of genitals
    e. NSFW variations.

  12. NSFW – Not Safe For Work

  13. WIP – Work In Progress

  14. NFT – Non-Fungible Token

  15. IP – Intellectual Property
     

GENERAL

  1. Artist RETAINS ALL COPYRIGHT to the artwork unless the Project IP is purchased by the Client for an additional fee.

    • Client may re-upload Artwork (to their personal social media accounts) as long as Artwork retains Artist signature AND the post contains a link to the original, Artist upload.

  2. Artist reserves the right to decline any Client Project for any reason with or without notice.

  3. Artist will, to the best of their ability, complete Projects within a one (1) to three (3) calendar month timeline.
    • Artist will, to the best of their ability, maintain communication with Client and keep Client apprised of any and all updates and/or delays to the Project.
    • Please allow 2 weeks minimum from Project start before asking for additional update(s).

  4. Artwork is NOT to be altered under ANY circumstances with exception for the following:
    a. Loose Sketches may, with the Artist approval, be coloured by Client or a Third Party hired by Client.
    b. Client may crop Artwork for personal use when necessary, such as icons, banners, or backgrounds for social media.

  5. Artwork may be shared within telegram or discord servers only as a direct link to Artist’s original upload.

  6. Artwork will be uploaded by Artist to one or more of the following sites:
    • HAUNTEWIRED a FurAffinity, Twitter, Pillowfort, and InkBlot [nsfw]
    • speckledplanets @ Twitter [sfw]
    • speckledplanet DeviantArt and Instagram [sfw]
     

ORDERING & PAYMENT

  1. Prices are non-negotiable.

  2. Payment plans are available for Projects above $300.
    a. 50% of fee due at hire.
    b. Must be paid off within one (1) month of the down payment.

  3. Private Commission fees will incur a 50% up-charge.

  4. NO REFUNDS except for in the following extraordinary circumstances:
    a. Artist cannot complete your project.
    b. Artist fails to send Client an update, WIP, or otherwise communicate with Client after a period of four (4) calendar months from hire.
     

PROCESS & DELIVERY

  1. WIPs will be provided to Client during the following stages of a project:
    a. rough sketch and clean sketch.
    (i) Additional WIPs may be provided, but are not guaranteed.
    (ii) Minor fixes may be requested by Client to correct any accidental omissions or errors.

  2. Once Project is approved, only two (2) Major Edits are provided as part of the
    commission process.
    • Any additional Major Edits will incur an additional fee on a sliding scale of $25–$50 per instance.

  3. Client may request an ALT of Artwork during the initial Sketch phase.
    • ALTs will incur an additional fee on a sliding scale of $15 – $25 per instance.

  4. Artwork will be sent to Client as a high-resolution PNG.
     

CLIENT PERMISSIONS FOR ADOPTS, CUSTOM DESIGNS & PERSONAL CHARACTERS

1. Adopts & Custom Designs:

a. May ONLY be Transferred to a Third Party by Client for the price paid to Artist UNLESS additional art is part of the sale.
b. Client does NOT need to notify Artist of Transfer.
c. May be edited or changed to suit Third Party's needs with approval of Artist.
d. CANNOT be used commercially without appropriate commercial license.

2. Personal Characters:

a. May ONLY be Transferred to a Third Party by Client for the price paid to Artist UNLESS additional art is part of the sale.
b. Client MUST notify Artist of Transfer.
c. May be edited or changed to suit Third Party's needs with approval of Artist.
d. CANNOT be used commercially without appropriate commercial license.

COMMERCIAL USE

  1. ARTIST DOES NOT AND WILL NOT SUPPORT THE PROLIFERATION OR
    CREATION OF NFTs.

  2. NO ARTWORK PRODUCED BY ARTIST MAY BE USED AS AN NFT.

  3. Artwork is not to be used for profit by the Client or any Third Party unless a commercial license is purchased for an additional fee.
    • This includes, but is not limited to: selling prints, stickers, pins, etc. of the project.

  4. Commissions CAN be included in the Transfer of any character they were drawn for.
